This Terms of Use describes and determines the terms and conditions applicable to your use of the Getamarket.com. This Terms of Use is an agreement into between Site Users and Getamarket.com.

Definitions

Getamarket.com: The following term “Getamarket.com” refers to the other extensions of www.getamarket.com and Getamarket.com which are “Getamarket.cn, Getamarket.com.tr, Getamarket.net, Getamarket.biz, Getamarket.org and Getamarket.co.uk.” In addition, when Getamarket.com is mentioned as a corporation, the reference is made to all employees, administrators, and all corporate parties and individuals liable and related to the services provided by Getamarket.com.

Site Users: The term “site users” mentioned in this document refers to all who has reached, opened, visited the site and/or registered as member of Getamarket.com

Registered User: Each User who has completed and submitted a registration form by giving its information (such as name, address, telephone and fax number, email address, details of its business, etc.) to Getamarket.com is a registered user of Getamarket.com.
Account: Upon registration to Getamarket.com, an account will be established for each Registered User. Each Registered User will be assigned a user alias ("User ID") and password.

Email Account: Every Registered User is given an exclusive mailing field to communicate with other Registered Users, which is an integral part of its Account.

Third Party Rights: Third party copyrights, trademarks, trade secret rights, patents and other personal or proprietary rights affecting or relating to material or information displayed on Getamarket.com, including but not limited to rights of personality and rights of privacy, or affecting or relating to products that are offered or displayed on Getamarket.com, are hereafter referred to as "Third Party Rights."

Transaction Risks: These are risks related to dealing with people acting under false pretences. Such risks shall include, but are not limited to, mis-representation of products and services, fraudulent schemes, unsatisfactory quality, failure to meet specifications, defective or dangerous products, unlawful products, delay or default in delivery or payment, cost mis-calculations, breach of warranty, breach of contract and transportation accidents. These risks also include the risks that the manufacture, importation, export, distribution, offer, display, purchase, sale and/or use of products or services offered or displayed on Getamarket.com may violate or may be asserted to violate Third Party Rights, and the risk that User may incur costs of defense or other costs in connection with third parties' assertion of Third Party Rights, or in connection with any claims by any party that they are entitled to defense or indemnification in relation to assertions of rights, demands or claims by Third Party Rights claimants. Such risks also include the risks that consumers, other purchasers, end-users of products or others claiming to have suffered injuries or harms relating to product originally obtained by Users of Getamarket.com as a result of purchase and sale transactions in connection with using Getamarket.com may suffer harms and/or assert claims arising from their use of such products.

Applicant: In this text, the word “Applicant” means those members who have applied for any paid services provided in Getamarket.com

General

Getamarket.com is a portal that shares the data of companies and individuals in its system with the whole wide world regardless of geographical restrictions.
Site Users shall be bound by the terms and conditions of this Terms of Use with respect to their access or use of Getamarket.com and any further upgrade, modification, addition or change. Site Users, without any restrictions, are considered to have accepted all rules and related legal practices comprised in this Terms of Use. Those who do not accept all of the terms and conditions of this Terms of Use, please do not use Getamarket.com. This Terms of Use was last amended on December 03, 2009. The Terms of Use may not be modified, except in writing by an authorized officer of Getamarket.com.

Terms of Use complement our Privacy Policy and the two will be considered together. All parties who use the Getamarket.com site are considered to have accepted the Terms of Use and the Privacy Policy.

These Terms of Use and the Privacy Policy are subject to change or update by Getamarket.com at any time. Users are considered to have accepted the liability of these revisions. In this sense, they must periodically visit this page for the valid, current conditions at any time.

Rules of Conduct

As an internet portal, Getamarket.com provides a service that enables companies and individuals to express and/or exhibit themselves, services and products and makes it possible for its members to communicate with other companies and individuals. It is Site Users’ and/or Members’ responsibility what kind of a business relationship they establish with other Users and/or Registered Members. Also, Getamarket.com is not responsible and has no interest whatsover for liability, authenticity, legality and actuality of any entity’s official and unofficial identity, documents…etc in their business process that starts with Site Users. Thus, before engaging in any kind of business, it is necessary to be heedful and investigate the companies and individuals thoroughly before taking a solid step.

Users are hereby made aware that there may be risks of dealing with people acting under false pretences. Getamarket.com uses several techniques to verify the accuracy of the information our users provide us when they register on Getamarket.com. However, because user verification on the Internet is difficult, Getamarket.com cannot and does not confirm each User's purported identity (including, without limitation, Premium membership). We encourage you to use the various tools available on Getamarket.com, as well as common sense, to evaluate with whom you are dealing.

Each User acknowledges that it is fully assuming the risks of purchase and sale transactions when using Getamarket.com to conduct transactions, and that it is fully assuming the risks of liability or harm of any kind in connection with subsequent activity of any kind relating to products or services that are the subject of transactions using Getamarket.com. Each User agrees that Getamarket.com shall not be liable or responsible for any damages, liabilities, costs, harms, inconveniences, business disruptions or expenditures of any kind that may arise a result of or in connection with any Transaction Risks.

Getamarket.com represents no company on the system and provides no agency services for anyone. With this document, whether a Registered User or not Users at Getamarket.com are warned to be heedful and investigate companies with the control mechanisms and general logic provided by the system before engaging in any business. With these Terms of Use, all Site Users are considered to have accepted that every kind of risk belongs to them and that they engage in business with their own conscious will.

Getamarket is not responsible for the accuracy and actuality of the information broadcasted on the portal by Users. Registered Members can modify their information broadcasted on Getamarket.com at any time they desire and can cancel their memberships.

Getamarket.com does not compensate for any of its members’ information and its accuracy. Those who engage in business on this portal are considered to have accepted the responsibility of all positive and negative consequences.

Copyright

Getamarket.com is the sole owner or lawful licensee of all the rights to Getamarket.com and Getamarket.com Content. Getamarket.com and its content embody trade secrets and intellectual property rights protected under worldwide copyright and other laws. All title, ownership and intellectual property rights in Getamarket.com ant its content shall remain with Getamarket.com, its affiliates or licensors of the Getamarket.com’s content, as the case may be. All rights not otherwise claimed under this Terms of Use or by Getamarket.com are hereby reserved.

As a condition of your access to and use of Getamarket.com, you agree that you will not use the Getamarket.com service to infringe the intellectual property rights or other legitimate rights of others in any way. Getamarket.com will in appropriate circumstances terminate the accounts of Users who are repeat infringers of the copyrights, or other intellectual property rights, or other legitimate rights of others. In addition, Getamarket.com reserves the right to terminate the account of a user upon any single infringement of the rights of others in conjunction with use of the Getamarket.com service, or if Getamarket.com believes that User's conduct is harmful to the interests of Getamarket.com, its affiliates, or other users, or for any other reason in Getamarket.com's sole discretion, with or without cause.

Each User hereby represents, warrants and agrees that it has obtained all necessary third party copyright, trademark, trade secrets or patent licenses and permissions, or such other licenses or permissions as may be required in connection with any other personal or proprietary rights of any third party (including but not limited to rights of personality and rights of privacy), for any material or information it posts on Getamarket.com or provides to Getamarket.com or authorizes Getamarket.com to display.

Each User hereby represents, warrants and agrees that it shall be solely responsible for ensuring that any material or information it posts on Getamarket.com or provides to Getamarket.com or authorizes Getamarket.com to display does not, and that the products represented thereby do not, violate any Third Party Rights, or is posted with the permission of the owner(s) of such rights. Each User hereby represents, warrants and agrees that it has the right to manufacture, offer, sell, import, export and distribute the products it offers and displays on Getamarket.com, and that such manufacture, offer, sale, importation, export and/or distribution of those products violates no Third Party Rights.

Rates and Payment

The services received by the members from Getamarket.com are included in the price. At the end of every membership period, members who wish to extend their membership pay the price Getamarket.com determines for that day of renewal. Any kind of increase on the price during the membership period will not be reflected to the members until the end of the membership period.

Getamarket.com holds its right to change the prices of the services it provides and can enjoy practice this right as it wishes.

No sales agency relationship is created between any User and Getamarket.com, our affiliates, directors, officers or employees by virtue of Getamarket.com's display of any of the User's information on Getamarket.com.

Getamarket.com may refuse registration and deny the issuance of an Account and/or Email Account and associated User ID and Password to any User for whatever reason.

A Registered User may not sell, attempt to sell, offer to sell, give, assign or otherwise transfer an Account, User ID or Password to a third party without the prior written consent of Getamarket.com. Getamarket.com may suspend or terminate the Account of a Registered User or the transferee of a Registered User in the event of a sale, offer to sell, gift, assignment or transfer in violation of this section.

Access to Getamarket.com and certain of its features are provided to all Users free of charge. However, Getamarket.com reserves the right, without prior notice, to restrict access to certain areas or features of Getamarket.com’s Premium Services to paying Users or Users who undergo a specific registration process.

Getamarket.com reserves the right to deny Premium Services to any User for whatever reason in order to protect the interests of Getamarket.com.

Getamarket.com holds its right to remove or modify the services it provides temporarily or permanently.

Using the Account

The Registered User shall not use the Email Account for junk mail, chain letters or spamming or the transmission of any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material of any kind or nature. Further, the Registered User shall not use the Email Account to publish, distribute, transmit or circulate any unsolicited advertising or promotional information or any content that is obscene, indecent, seditious, offensive, defamatory, threatening, or which incites or results in causing racial hatred, discrimination, menace or breach of confidence.

Getamarket.com reserves the right to limit, deny or create different access to Getamarket.com and its features with respect to different Users, or to change any of the features or introduce new features without prior notice. Each User acknowledges that inability to use Getamarket.com wholly or partially for whatever reason may have adverse effects on its business. Each User hereby agrees that in no event shall Getamarket.com be liable to the User or any third parties for any inability to use Getamarket.com (whether due to disruption, limited access, changes to or termination of any features on Getamarket.com or otherwise), any delays, inaccuracies, errors or omissions with respect to any communications or transmission, or any damage (direct, indirect, consequential or otherwise) arising from the use of or inability to use Getamarket.com or any of its features.

In case the Username and Password of a certain member are used by someone else without the user’s consent, it is the member’s responsibility to warn Getamarket.com of the situation and exit Getamarket.com by closing their browser after their visit. Getamarket.com holds no responsibility for the loss or modification of information due to such reasons.

Materials published by Users and Registered Members

Only a Registered User can post information using the self-help submit and edit tools provided on Getamarket.com. The status of a Registered User is governed by the provisions, terms and conditions applicable to the relevant Premium Service stated in this Terms of Use.

If any company is discovered to provide information that causes detriment on Getamarket.com or Users, Getamarket.com can ban the broadcast of information belonging to that particular Site User.

All Registered Users are considered to have accepted that the products they present and the information they broadcast in the system are not stolen or fake; do not pertain to other corporate parties’ or individuals’ right of registry; comprise no illegal or pornographic material; contain no viruses or defective software; and are not used to send unwanted (spam/junk mail etc.) mail, documents and/or messages to other members. Getamarket.com keeps its right to cancel the accounts of members who enter data inconsistent with the above mentioned legal and/or moral norms and refuse to correct after being warned.

If the data being submitted at the time of application is found to be false, fabricated, misleading or in any way inaccurate, Getamarket.com maintains the right to refuse the application in which case any payment made at the time of application will be automatically forfeited by the Applicant.

Each User hereby represents, warrants and agrees that information submitted to Getamarket.com for display on Getamarket.com shall not:

(a) contain fraudulent information or make fraudulent offers of items or involve the sale or attempted sale of counterfeit or stolen items or items whose sales and/or marketing is prohibited by applicable law, or otherwise promote other illegal activities;

(b) be part of a scheme to defraud other Users of the Site or for any other unlawful purpose;

(c) relate to sale of products or services that infringe or otherwise abet or encourage the infringement or violation of any third party's copyright, patent, trademarks, trade secret or other proprietary right or rights of publicity or privacy, or any other Third Party Rights;

(d) impersonate any person or entity, misrepresent yourself or your affiliation with any person or entity;

(e) violate any applicable law, statute, ordinance or regulation (including without limitation those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising);

(f) be defamatory, libelous, unlawfully threatening or unlawfully harassing;

(g) be obscene or contain or infer any pornography or sex-related merchandising or any other content or otherwise promotes sexually explicit materials or is otherwise harmful to minors;

(h) promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;

(i) contain any material that constitutes unauthorized advertising or harassment (including but not limited to spamming), invades anyone's privacy or encourages conduct that would constitute a criminal offence, give rise to civil liability, or otherwise violate any law or regulation;

Getamarket.com reserves the right in its sole discretion to remove any material displayed on Getamarket.com which it reasonably believes is unlawful, could subject Getamarket.com to liability, violates this Agreement or is otherwise found inappropriate in Getamarket.com's opinion. Getamarket.com reserves the right to cooperate fully with governmental authorities, private investigators and/or injured third parties in the investigation of any suspected criminal or civil wrongdoing. Furthermore, Getamarket.com may disclose the User's identity and contact information, if requested by a government or law enforcement body, an injured third party, or as a result of a subpoena or other legal action, and Getamarket.com shall not be liable for damages or results thereof and User agrees not to bring any action or claim against Getamarket.com for such disclosure. In connection with any of the foregoing, Getamarket.com may suspend or terminate the Account of any User as Getamarket.com deems appropriate in its sole discretion. User agrees that Getamarket.com shall have no liability to User, including no liability for consequential or any other damages, in the event Getamarket.com takes any of the actions mentioned in this Section, and that User agrees to bear the risk that Getamarket.com may take such actions.

Information related to Registered Users in the system cannot be sold, rented or assigned to third parties.

Rejection of Representation and Guarantee

Services provided on the Getamarket.com portal are based on the “as it is” and “as available” policy. GETAMARKET.COM HEREBY EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF CONDITION, QUALITY, DURABILITY, PERFORMANCE, ACCURACY, RELIABILITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. ALL SUCH WARRANTIES, REPRESENTATIONS, CONDITIONS, UNDERTAKINGS AND TERMS ARE HEREBY EXCLUDED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, GETAMARKET.COM MAKES NO REPRESENTATIONS OR WARRANTIES ABOUT THE VALIDITY, ACCURACY, CORRECTNESS, RELIABILITY, QUALITY, STABILITY, COMPLETENESS OR CURRENTNESS OF ANY INFORMATION PROVIDED ON OR THROUGH GETAMARKET.COM. GETAMARKET.COM DOES NOT REPRESENT OR WARRANTY THAT THE MANUFACTURE, IMPORTATION, EXPORT, DISTRIBUTION, OFFER, DISPLAY, PURCHASE, SALE AND/OR USE OF PRODUCTS OR SERVICES OFFERED OR DISPLAYED ON THE SITE DOES NOT VIOLATE ANY THIRD PARTY RIGHTS. GETAMARKET.COM MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND CONCERNING ANY PRODUCT OR SERVICE OFFERED OR DISPLAYED ON THE SITE. Getamarket.com cannot be held responsible for any deficient or missing information. Site Users are considered to have accepted that Getamarket.com cannot be held responsible for force majeure like natural disasters, earthquakes, fire, problems on the communication network, war, strikes, explosions, storms, floods, demonstrations, state/government practices, internet problems, power failures, serious disasters, epidemics and/or quarantines, software failures, problems related to hardware and other events that take place outside Getamarket.com’s will. Getamarket.com provides no guarantee to any of its members on the business connections, offers and commercial results on the portal. Getamarket.com cannot be held responsible for any kind of direct or indirect loss including data, profit, connection and opportunity due to the use or misuse of this site. While accepting to do its best to provide a fair technical performance of the portal, Getamarket.com does not guarantee the accuracy, permanence, liability of any information on the site or the technical performance, speed or quality of the site. Getamarket.com does not guarantee that any product or service broadcasted, displayed, sold, manufactured, marketed, distributed in the system does not violates some other third party’s rights and Getamarket.com does not represent or guarantee any product broadcasted/displayed through the system. Every company and individual is considered to have known these matters and accepted its membership “voluntarily.”

Getamarket.com shall not be liable for any special, direct, indirect, punitive, incidental or consequential damages or any damages whatsoever (including but not limited to damages for loss of profits or savings, business interruption, loss of information), whether in contract, negligence, tort or otherwise or any other damages resulting from any of the following:

(a) the use or the inability to use Getamarket.com;

(b) any defect in goods, samples, data, information or services purchased or obtained from a User or a third-party service provider through Getamarket.com;

(c) violation of Third Party Rights or claims or demands that Users' manufacture, importation, export, distribution, offer, display, purchase, sale and/or use of products or services offered or displayed on the Site may violate or may be asserted to violate Third Party Rights; or claims by any party that they are entitled to defense or indemnification in relation to assertions of rights, demands or claims by Third Party Rights claimants;

(d) unauthorized access by third parties to data or private information of any User;

(e) statements or conduct of any User of Getamarket.com; or

(f) any matters relating to Premium Services however arising, including negligence.

Notwithstanding any of the foregoing provisions, the aggregate liability of Getamarket.com, its employees, agents, affiliates, representatives or anyone acting on its behalf with respect to each Use for all claims arising from the use of Getamarket.com or its services shall be limited to the greater of (a) the amount of fees the User pays to Getamarket.com or its affiliates in the 12 months. The preceding sentence shall not preclude the requirement by the User to prove actual damages. All claims arising from the use of Getamarket.com or its services must be filed within one (1) year from the date the cause of action arose.

Cancellation

Getamarket.com or its affiliates may suspend or terminate a Registered User's Account or Email Account at any time by giving no less than 24-hour notice to the Registered User. However, if in Getamarket.com's determination, there is any breach of the provisions of this Terms of Use by the Registered User; or Getamarket.com has reasonable grounds to suspect that such information provided by a Registered User is untrue, inaccurate or is not current or complete, or Getamarket.com believes that the Registered User's actions may cause financial loss or legal liability to such Registered User, Getamarket.com’s other Users, or Getamarket.com or its affiliates, that notice is not required for such termination.

Concluding Remarks

Terms of Use is a whole with Privacy Policy and will be considered together. With this document, Getamarket.com members are considered to have accepted that courts in Bursa/Turkey will be authorized in any kind of judicial disagreement, regardless of international legislative differences.
